К ВОПРОСУ О СТАТУСЕ СОТРУДНИКОВ ИНОСТРАННЫХ КОМПАНИЙ, УЧАСТВУЮЩИХ В ВООРУЖЕННЫХ КОНФЛИКТАХ

Abstract

В данной статье рассмотрена проблема статуса частных военных компаний как в "развитых" странах, так и в Российской Федерации. Нами были обозначены пробелы в законодательстве, поясняющие положение частных военных компаний, сотрудников в качестве "наемников". Тенденция возникновения частных военных компаний в Российской Федерации набирает стремительные обороты, но их правовой статус до сих пор не определен. Закрепление решения этой проблемы на законодательном уровне, внедрение зарубежного опыта и многое другое предусмотрено в настоящей статье.

This article deals with the problem of the status of private military companies in both "developed" countries and in the Russian Federation. We have identified gaps in the legislation explaining the position of private military companies, employees as "mercenaries". The trend of the emergence of private military companies in the Russian Federation is gaining momentum, but their legal status has not yet been determined. Fixing the solution of this problem at the legislative level, the introduction of foreign experience and much more is provided in this article.
